中国法治建设年度报告2013（中英文）

　　由中国法学会编著的法治建设年度报告，是中国法治建设年度白皮书，具有客观性、公正性和权威性。是全国**由学术性团体、人民团体发布的中国法治建设年度报告。 

　　本书运用中英文对照的形式，从9个方面对我国2013年法治建设进程进行了全面概括，并对2013年我国法治建设取得的新成就、新进展及存在的新问题和重要意义进行了阐释。

　　中国法学会隶属中国人大常委会法治委员会，是由各省（自治区、直辖市）、地（市）、县（市）法学会和各全国性学科、专业、专门研究会联合组成的人民团体。是中国法学界、法律界的全国性学术团体。

　　前 言

　　2013年，是中国实施“十二五”规划承前启后、为全面建成小康社会奠定坚实基础的重要一年。面对经济社会发展的新要求和人民群众的新期待，中国全力推进平安中国、法治中国建设，切实保障宪法法律实施，不断完善中国特色社会主义法律体系，加快建设法治政府，努力推动中国特色社会主义司法制度的完善和发展，切实提升执法司法公信力，积极弘扬法治精神，大力繁荣法学研究，开创了中国法治建设的崭新局面。
　　2013年11月，中国共产党十八届三中全会通过了《关于全面深化改革若干重大问题的决定》，围绕完善和发展中国特色社会主义制度、推进国家治理体系和治理能力现代化的总目标，对推进法治中国建设作出新的战略部署。《决定》强调指出，建设法治中国，必须坚持依法治国、依法执政、依法行政共同推进，坚持法治国家、法治政府、法治社会一体建设。《决定》进一步明确了维护宪法法律权威，深化行政执法体制改革，确保依法独立公正行使审判权、检察权，健全司法权力运行机制，完善人权司法保障制度等任务和要求，为新时期中国的法治建设指明了方向。2013年中国法治建设的成就、进展和举措，都成为法治中国铿锵前行的坚实印迹。

　　2013 was an important year for China in carrying out the “Twelfth Five-Year Plan” in its efforts to lay a firm foundation for achieving a moderately prosperous society. Confronted with the new requirements of the economic and social development and the new expectations of the people, China made an all-out effort to build a safe China and a law-ruled China, earnestly ensured the implementation of the Constitution and other laws, continued to improve the socialist legal system with Chinese characters and accelerated the building of a law-based government. It endeavored to promote the development and improvement of the judicial system with Chinese characters, earnestly uplifted the credibility of both justice and law enforcement, actively carried forward the spirit of the rule of law, developed the legal research energetically, and ushered in a new situation in promoting the rule of law in China.
　　In November, 2013, the Decision on Some Major Issues Concerning Comprehensively Deepening Reforms (hereinafter referred to as the Decision) was adopted at the Third Plenary Session of the Eighteenth Central Committee of the Communist Party of China. The Decision adopted a new strategic planning for promoting the rule of law in China, centering on the overall goal of improving and developing the socialist system with Chinese characteristics, and promoting the modernization of the national governance system and capacity. The Decision emphasized that to build a China under the rule of law, we must uphold the unity of the rule of law, law-based government and law-based administration, and the integral development of a law-based country, government and society as a whole The Decision further clarified the tasks and requirements of protecting the authority of the Constitution and laws, deepening the reform of the administrative law-enforcement system, ensuring the independent exercise of the judicial and procuratorial power in accordance with the law, improving the mechanism for the use of judicial power, and improving the judicial system to protect human rights, thus showing the orientation for building China under the rule of law in the new period. The achievements and progress made and the measures taken in building China under the rule of law in 2013 were the solid foot marks printed in the headlong advance in promoting the rule of law in China.
